7.2 Terms of Service
APUS Wallet Terms of Service
Effective Date: February 1, 2025
By using APUS Wallet, you acknowledge that you have read, understood, and agreed to these Terms of Use (“Terms”). These Terms govern access to and use of the APUS Wallet application and related services (collectively, the “Services”). By accessing or using the Services, you are deemed to have agreed to be bound by these Terms. If you do not agree to these Terms, please discontinue your use of the Services.
Non-Custodial Wallet
APUS Wallet is a non-custodial wallet, and users bear full responsibility for safeguarding their assets.
The APUS Wallet team does not store, manage, or otherwise access users’ private keys, passkeys, or wallet contents.
Users alone are responsible for maintaining the confidentiality and security of the passkey, which is the sole credential for accessing APUS Wallet. If the passkey is lost, access to the wallet and all associated assets will be irrecoverably lost.
Account and Passkey Security
By using APUS Wallet, you agree that you are fully responsible for the security of your passkey and any related information necessary to access the Services.
You acknowledge and accept that if the passkey is lost, the APUS Wallet team cannot recover or restore access to the wallet or its assets. You agree to securely store the passkey and use reliable methods to protect it from unauthorized access.
User Responsibilities
Users are responsible for understanding and complying with all laws, rules, and regulations applicable to their use of APUS Wallet.
This includes regulations related to digital assets and stablecoins in the user’s jurisdiction. Neither APUS Wallet nor its team shall be held liable for any legal violations or consequences arising from a user’s use of the Services.
Prohibited Conduct
Users agree not to use APUS Wallet for any illegal, illicit, or malicious activities, including but not limited to:
Money laundering, fraud, or other financial crimes
Engaging in activities prohibited by local or international laws
Attempting unauthorized access to any aspect of the Services
Interfering with or disrupting the operation of the Services
APUS Wallet reserves the right to restrict access to the Services or terminate accounts for violations of these Terms or involvement in unlawful activities.
Limitation of Liability
To the maximum extent permitted by law, the APUS Wallet team shall not be liable for direct, indirect, incidental, or consequential damages resulting from:
Loss or unauthorized access to passkeys or private keys
Inability to access the wallet or assets due to lost passkeys
Errors, interruptions, or delays in the Services
Security breaches, theft, or unauthorized third-party access to the wallet. APUS Wallet disclaims any liability for losses or damages arising from illegal activities or misuse of the Services by the user.
Disclaimer of Warranties
APUS Wallet is provided on an “as is” and “as available” basis without any warranties, express or implied.
This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
APUS Wallet does not guarantee uninterrupted or error-free operation of the Services, nor does it guarantee the security of user assets.
Execution and Gas Fees
Transactions within APUS Wallet may incur execution fees, using APUS as gas. Users are responsible for understanding and accepting any applicable execution fees for transactions made through the Services.
APUS Wallet does not control or set gas fees, which depend on conditions in the blockchain network.
Service and Terms Modification
The APUS Wallet team reserves the right to modify or discontinue the Services, temporarily or permanently, with or without notice. The team also reserves the right to revise these Terms.
Any changes to the Terms will be posted within the Services or on the official website. Continued use of APUS Wallet after the revised Terms are posted signifies acceptance of those Terms.
User Acknowledgment and Acceptance
By using APUS Wallet, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
You also accept the risks associated with using a non-custodial wallet and bear full responsibility for the security of your assets and passkey.
Governing Law and Dispute Resolution
These Terms are governed by and interpreted in accordance with the laws of Vietnam.
Any dispute arising out of or in connection with these Terms or the use of APUS Wallet shall be resolved through binding arbitration in Vietnam, and you waive any right to participate in class action litigation.
